Clients MUST be 18 years or older to agree to these terms.

Clients DO NOT have the right to mint/sell their commissions as NFT nor use the art for generative AI purposes. Doing so is in violation of these terms.

Clients may not copy or trace my work in any way, unless expressly given permission.

Clients are required to give Credit to the Artist when reposting commissioned work

Clients may edit their commissioned works in minor ways, such as use in Profile Pictures, Social Media Banners, or Youtube Thumbnails and similar cases.

Clients may produce physical reproductions of their work for PERSONAL use only (Not for sale), unless Commercial/Promotional rights are purchased (Check section 3)

I retain the copyright to all work I produce. This includes use of the work for self-promotion, as example work in sales of commissions, the right to redistribute, and the right to reproduce the work, unless an agreement is made stating otherwise. For commissions that are public (no limitations stated on posting the work) I may post these works to my other social media platforms with proper credit to the client for ownership of the character’s design.

+25% Digital Promotional Material (Use in Digital monetized content. – Ex. Overlays, Thumbnails, and other directly monetized content.)

+200% Reproduction, Sale and Merchandise (Use in merchandise for sale. – Ex. Art Prints, apparel designs, charms or keychain designs.)

Clients are expected to be aware of their financial status before ordering

I will not begin work on a commission until full payment is received OR 1st payment of an agreed upon payment plan is received. Payment plans are only accepted for commissions exceeding $200 USD

I can cancel, adjust, and/or remind commissioners of any invoices before final payment is made if necessary.

Payment will be sent through Invoices only. All prices are expressed in U.S. dollars (USD)

Accepted payment methods: Paypal Invoice or Credit/Debit Card via Stripe Invoice.

Additional fees may apply depending on what the work is intended to be used for. Please see section 03 Usage & NDA

Expect a turnaround of 1-2 months for an Illustration or 2-4 months for Character Design.The Artist will notify the Client in the event of a delay, be it through emergency, conflict with schedule, etc.

Commission availability is updated through posts on social media. After closing form submissions, I will reach out to those selected for that batch via the mode of contact listed on the form. This will generally happen within a week.

I will announce on my social media when all chosen projects have been contacted. I WILL NOT contact those I haven’t chosen.

On the Commission Form, the Client is expected to provide a clear description of what they want to be depicted in the artwork, along with links or files of clear reference photos.

Upon receiving the commission payment, I will send an initial sketch for approval. Any changes done during the sketch stage are free.

Major revisions such as Pose changing, a different composition or character/ outfit design etc.. past the stage of final sketch phase will incur additional charges to the original commissions price.

Any changes made because of a forgotten detail will be done for free.

Commission updates are given at the start of each phase or at the request of the Client.

A full refund may occur if the commission was cancelled before Subajelly has started to work on it.

After the start of the commission process, a partial refund may be available depending on what extent the project is completed.

Partial refunds may be available if Subajelly has failed to deliver a commission in a reasonable, timely manner. (Exceeding 6 months with no communication.) Some leniency is allowed as long as delays in expected project timeline are clearly communicated with the Client.

Upon completion (or upon the final payment if using a payment plan), Commissions will be submitted in their full resolution through invoice email, along with a glazed version to post on social media. You don’t have to use the glazed version to post, but it’s recommended to protect your work.
